KOM Obtains Favorable Settlement For Client

Douglas M. Chapman recently obtained a favorable settlement for an engineering client of Kupelian Ormond & Magy, P.C.  A Fortune-500 Company was sued after a contractor’s employee was killed on a work project site that the Company purported to own.  The employee’s estate filed a wrongful death lawsuit against the Fortune-500 Company, which sought indemnity from KOM’s client pursuant to a written indemnity agreement.  The Wayne County Circuit Court initially granted summary disposition for the Fortune-500 Company, ordering KOM’s client to indemnify the Company potentially in excess of $1,000,000.  Mr. Chapman then uncovered evidence casting the Court’s determination into doubt and successfully convinced the Court stay its order pending further examination of the evidence.  During the stay, the Fortune-500 Company accepted a negligible settlement offer from KOM’s client in exchange for a dismissal with prejudice.  Mr. Chapman represents engineering clients in professional negligence lawsuits and other related matters.
