KOM Obtains Summary Disposition Regarding Other Insurer’s Duty To Defend
In an insurance coverage duty-to-defend matter, Douglas M. Chapman obtained summary disposition in Oakland County Circuit Court for an insurance carrier client of Kupelian Ormond & Magy, P.C. KOM’s client was one of two carriers defending a mutual insured against an underlying lawsuit. The two carriers filed a lawsuit against a third carrier, alleging the third carrier also had a duty to defend the mutual insured. After discovery, Mr. Chapman filed a motion for summary disposition on behalf of KOM’s insurance carrier client; the co-plaintiff carrier joined in KOM’s client’s motion. After holding the motion under submission for nearly a year, the Court granted KOM’s client’s motion, holding the defendant carrier also had a duty to defend the mutual insured. Mr. Chapman represents insurance carrier clients in insurance coverage litigation and other related matters.
